Terms of service

General Terms and Conditions of ABT Sportsline GmbH (as of 09.06.2026)

§ 1 Scope

1. The applicable General Terms and Conditions (hereinafter: "GTC") can be accessed free of charge at any time on the website of ABT SE at www.abt-sportsline.de in a form that can be saved and printed.

2. These GTC apply to all contracts, in particular purchase contracts, contracts for work and services and service contracts of the customer/supplier (hereinafter: "Contracting Party") with the ABT SE group and its affiliated companies: ABT Sportsline GmbH, ABT e-Line GmbH, ABT Servicecenter GmbH, ABT Lifestyle GmbH, Johann-Abt-Straße 2, 87437 Kempten (hereinafter: "ABT"). The inclusion of the Contracting Party's own terms and conditions is hereby rejected if the Contracting Party is a special fund under public law or an entrepreneur, unless expressly agreed otherwise. With reference to § 14 BGB (German Civil Code), an entrepreneur within the meaning of these GTC is any natural or legal person or partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their independent commercial or professional activity.
3. The GTC in the version valid at the time the contract is concluded shall apply in each case.

4. The GTC form part of the contract unless otherwise agreed in an individual agreement between ABT and the Contracting Party in text form pursuant to § 126b BGB.
5. Amendments and additions to a contract must be made in text form. For consumers, however, the text form requirement applies only to notices and declarations of the Contracting Party. For contractual agreements with Contracting Parties who are consumers, the text form requirement serves evidentiary purposes only, without excluding other means of proof. Pursuant to § 13 BGB, a consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.

§ 2 Conclusion of Contract

1. Offers made by ABT, including those on its website, are subject to change and non-binding unless expressly agreed otherwise. Drawings, illustrations, descriptions, dimensions, weights or other performance data (such as speeds) are only binding if this has been expressly agreed in writing.

2. ABT reserves the right to make reasonable technical and design deviations from information in brochures, catalogues and written documents, as well as changes to models, design and materials in the course of technical progress and further development, without any rights being derived against ABT as a result, in particular where orders in the areas of engine technology, chassis and exhaust technology that depend on vehicle-specific data are affected.

3. Contracts between ABT and the Contracting Party are concluded after ABT has sent an offer/order confirmation, upon acceptance by the Contracting Party in text form pursuant to § 126b BGB, or upon delivery of the purchased item by ABT. For a Contracting Party who is a consumer, the text form requirement serves evidentiary purposes only, without excluding other means of proof.

4. If ABT prepares a cost estimate, the services rendered may be charged to the Contracting Party if this has been agreed in the individual case. If an order is placed on the basis of this cost estimate, any costs for the cost estimate will be offset against the invoice for the order.

§ 3 Completion and Terms of Delivery

1. The delivery or performance date for the order and the delivery or performance period for the order are agreed on the basis of ABT's expected capacity and are non-binding and subject to unforeseen circumstances and obstacles, regardless of whether these occur at ABT or at the manufacturer, in particular force majeure, government measures, failure to obtain official approvals, industrial action of any kind, sabotage, shortage of raw materials, and delayed delivery of materials through no fault of ABT. Such events extend the delivery or performance date accordingly, even if they occur during a delay that has already arisen. Any grace period set by the Contracting Party in such a case is also extended by the duration of the unforeseen event. In the event of such occurrences, ABT is in particular not obliged to provide a replacement vehicle or to reimburse the costs of actually using a rental vehicle. However, ABT is obliged to inform the Contracting Party of the delays insofar as this is possible and reasonable. If such events lead to a postponement of performance of more than four months, the Contracting Party may withdraw from the contract. The Contracting Party's statutory rights of withdrawal, e.g. due to frustration of contract or impossibility for which the Contracting Party is not responsible, remain unaffected.

2. If the scope of work changes or is extended compared to the original order and a delay occurs as a result, ABT shall immediately specify a new completion date, stating the reasons. If the dispatch of goods ready for shipment is delayed for reasons for which ABT is not responsible, the contractual products may be stored at the expense and risk of the Contracting Party.
3. ABT expressly reserves the right in particular to make reasonable partial deliveries/partial performances and to invoice them.
4. If the Contracting Party is a special fund under public law or an entrepreneur within the meaning of § 1 para. 1 of the GTC, the risk of accidental loss and accidental deterioration of the goods in the case of a sale involving shipment passes upon handover of the goods to the forwarding agent, the carrier or the person otherwise designated to carry out the shipment.
If the Contracting Party is a consumer, the risk of accidental loss and accidental deterioration in the case of a sale involving shipment passes to the buyer only if the buyer has commissioned the forwarding agent, the carrier or the person or institution otherwise designated to carry out the shipment, and the entrepreneur has not previously named this person or institution to the buyer.

5. Packaging costs for deliveries of goods are included in the shipping costs. ABT takes back packaging within Germany free of charge.

§ 4 Place of Performance

1. Unless otherwise agreed, the place of performance for services is ABT's registered office in Kempten. For contracts with ABT Sportsline GmbH and ABT Servicecenter GmbH, the Contracting Party shall bring the object of the order to the place of performance on the agreed date at its own expense.

2. Unless otherwise agreed, rectification work on services is carried out exclusively at ABT's registered office in Kempten. If the Contracting Party is a special fund under public law or an entrepreneur within the meaning of § 1 para. 1 of the GTC, transport and travel costs shall be borne by the Contracting Party.

§ 5 Acceptance and Collection

1. The Contracting Party is obliged to accept the purchased item or to collect the object of the order within 2 weeks of receipt of the notice of completion and handover or dispatch of the invoice. For services carried out by ABT within one working day, the aforementioned period is reduced to 3 working days.

2. In the event of default of acceptance, ABT may charge the customary local storage fee. The costs and risks of storage shall be borne by the Contracting Party.

3. If the purchased item/object of the order is not accepted, ABT may exercise its statutory rights.
If a new vehicle is not accepted, ABT may claim damages amounting to 15% of the purchase price. The damages shall be set higher or lower if ABT proves greater damage or the Contracting Party proves that less damage or no damage at all has occurred.
If a used vehicle is not accepted, ABT may claim damages amounting to 10% of the purchase price. The damages shall be set higher or lower if ABT proves greater damage or the Contracting Party proves that less damage or no damage at all has occurred.

4. If the Contracting Party withdraws from the contract or cancels the order before completion of the purchased item or object of the order, ABT may claim damages amounting to 10% of the net contract value. This does not apply in cases where the Contracting Party is entitled to a right of withdrawal under § 3 no. 1 of the GTC and has exercised this right of withdrawal. The damages shall be set higher or lower if ABT proves greater damage or the Contracting Party proves that less damage or no damage at all has occurred.
5. If ABT and the Contracting Party agreed upon conclusion of the contract that the Contracting Party makes a down payment and the Contracting Party has made this down payment, ABT is entitled to offset its claims for damages against the Contracting Party's claim for repayment of the down payment.

§ 6 Technical Inspection and Registration

After the technical inspection has been carried out (TÜV, Dekra or similar), the Contracting Party is obliged to have the technical modification entered in the vehicle documents without delay at the registration authority responsible for them. ABT also recommends that the Contracting Party inform its motor vehicle insurer of the modifications to the vehicle.

§ 7 Execution of Orders

1. The Contracting Party expressly authorises ABT to carry out test drives and transfer drives with the object of the order.
2. If necessary, ABT will update the object of the order to the latest software version. Where technically possible, vehicle data will be temporarily backed up in encrypted form in this context. Irrespective of this, the Contracting Party is strongly advised to back up data and individual settings in the vehicle in accordance with the operating instructions in order to avoid data loss. The software update may also result in modifications to the design of functional features.

3. After wheels have been fitted, the wheel bolts must be retightened after 50 to 100 km.

§ 8 Replacement Parts

Unless otherwise agreed when the order was placed, replaced parts become the property of ABT.

§ 9 Retention of Title

1. The following provisions regarding retention of title are agreed between ABT and a Contracting Party who is a special fund under public law or an entrepreneur within the meaning of § 1 para. 1 of the GTC:
a) ABT retains title to the delivered goods until full payment of all current and future claims arising from the purchase contract and an ongoing business relationship (secured claims).

b) Until the secured claims have been paid in full, the goods subject to retention of title may neither be pledged to third parties nor transferred as security. The Contracting Party must notify ABT in writing without delay if an application for the opening of insolvency proceedings is filed or if third parties access the goods belonging to ABT (e.g. seizures). If the third party is unable to reimburse ABT for the judicial and extrajudicial costs of an action pursuant to § 771 ZPO (German Code of Civil Procedure), the Contracting Party shall be liable for the loss incurred by ABT.
c) In the event of conduct by the Contracting Party in breach of contract, in particular non-payment of the purchase price due, ABT is entitled to withdraw from the contract in accordance with the statutory provisions and/or to demand return of the goods on the basis of the retention of title. A demand for return does not at the same time constitute a declaration of withdrawal; rather, ABT is entitled to merely demand return of the goods and to reserve the right to withdraw. If the Contracting Party does not pay the purchase price due, ABT must have set the Contracting Party a reasonable deadline for payment without success before asserting these rights. This applies only if setting such a deadline is not dispensable under the statutory provisions.
d) Until revoked in accordance with VII. 4. lit. c, the Contracting Party is authorised to resell and/or process the goods subject to retention of title in the ordinary course of business. In this case, the following provisions apply in addition:

aa) The products resulting from the combination, mixing or processing of ABT's goods are subject to retention of title at their full value, with ABT being deemed the manufacturer. If, in the event of combination, mixing or processing with goods of third parties, their right of ownership remains, ABT acquires co-ownership in proportion to the invoice values of the combined, mixed or processed goods. Otherwise, the same applies to the resulting product as to the goods delivered under retention of title.
bb) The Contracting Party hereby assigns to ABT, as security, the claims against third parties arising from the resale of the goods or the product, in full or in the amount of any co-ownership share of ABT pursuant to § 9 no. 1 lit. d) aa), in the amount of the final invoice amount agreed with ABT (including VAT). ABT accepts the assignment. The obligations of the Contracting Party set out in § 9 no. 1 lit. b) also apply with regard to the assigned claims.
cc) The Contracting Party remains authorised to collect the claim alongside ABT. As long as the Contracting Party meets its payment obligations towards ABT, there is no deficiency in the Contracting Party's ability to pay, and ABT does not assert the retention of title by exercising a right pursuant to § 9 no. 1 lit. c), ABT undertakes not to collect the claim. If ABT asserts the exercise of a right pursuant to § 9 no. 1 lit. c), ABT may demand that the Contracting Party disclose the assigned claims and their debtors, provide all information required for collection, hand over the relevant documents and notify the debtors (third parties) of the assignment. In addition, ABT is entitled to revoke the Contracting Party's authorisation to resell and to process the goods subject to retention of title.
dd) If the realisable value of the securities exceeds ABT's claims by more than 10%, ABT will release securities of its choice at the request of the Contracting Party.
e) As long as ownership has not yet passed to the Contracting Party, the Contracting Party is obliged to treat the purchased item with care. If maintenance and inspection work must be carried out, the Contracting Party must carry this out in good time at its own expense.

2. The following provisions regarding retention of title are agreed between ABT and a Contracting Party who is a consumer:
a) ABT retains title to the delivered goods until full payment of all claims arising from the delivery contract.
b) As long as ownership has not yet passed to the Contracting Party, the Contracting Party is obliged to treat the purchased item with care, store it carefully and keep it in perfect condition. As long as ownership has not yet passed, the Contracting Party must notify ABT without delay in text form pursuant to § 126b BGB if the delivered goods are seized or subject to other interventions by third parties. In the event of seizure, the enforcement officer must also be informed of the retention of title immediately and ABT must be provided with the documents necessary for the objection. If the third party is unable to reimburse ABT for the judicial and extrajudicial costs of an action pursuant to § 771 ZPO, the Contracting Party shall be liable for the loss incurred by ABT.

c) If the delivered goods subject to retention of title are processed by the Contracting Party, the processing is carried out in the name and on behalf of ABT. ABT acquires co-ownership of the new item in proportion to the value of the goods subject to retention of title to the other processed items at the time of processing. The Contracting Party shall hold the co-ownership thus created in safe custody for ABT free of charge.
d) If the goods subject to retention of title are inseparably combined or mixed with other items not belonging to ABT, ABT acquires co-ownership of the new item in proportion to the value of the goods subject to retention of title to the other combined or mixed items at the time of combination or mixing. If the combination or mixing takes place in such a way that the Contracting Party's item is to be regarded as the main item, it is deemed agreed that the Contracting Party transfers proportionate co-ownership to ABT. The Contracting Party shall hold the co-ownership thus created in safe custody for ABT free of charge.

e) At the request of the Contracting Party, ABT undertakes to release the securities to which it is entitled to the extent that the realisable value of the securities exceeds the claim to be secured by more than 10%. The selection of the securities to be released is at ABT's discretion.
f) As long as the retention of title exists, any modification to the detriment of ABT, any sale, pledge, transfer by way of security or other transfer of the object of the order to third parties without the written consent of ABT is not permitted. The buyer hereby assigns to ABT, as security, any claims against third parties arising from resale nevertheless, in the amount of the invoice value of ABT's claim.

g) If the Contracting Party culpably defaults on payment despite a deadline having been set, ABT is authorised to collect the purchased item from the Contracting Party. The costs of collection shall be borne by the Contracting Party.

§ 10 Supply of Spare Parts

Due to the small production quantities, the supply of spare parts can only be guaranteed within the respective warranty period.

§ 11 Liability for Material Defects, Limitation Period

1. If there are defects, the Contracting Party who is a special fund under public law or an entrepreneur within the meaning of § 1 para. 1 of the GTC is entitled to the statutory warranty rights in accordance with the following provisions:
If only merchants are involved in a purchase contract and it is a commercial transaction for both parties, the provisions of the HGB (German Commercial Code) also apply.
Defects in the object of the contract must be described precisely by the Contracting Party. The notice of defects must be given in text form pursuant to § 126b BGB, setting a reasonable deadline for remedying the defect.
If the object of the order becomes inoperable due to a material defect, the provisions for consumers under § 11 no. 2 of the GTC apply.
Claims of the Contracting Party due to material defects in the delivery of used items are excluded.
Claims of the Contracting Party due to defects in the object of the order become time-barred one year after performance and its acceptance, unless otherwise agreed.
The above exclusion of liability and the above reductions of the limitation period do not apply

- in the event of an intentional breach of duty by ABT;
- in the event of a grossly negligent breach of duty by ABT or an intentional or grossly negligent breach of duty by a legal representative or vicarious agent of ABT;
- in the event of damage resulting from injury to life, body or health based on a negligent breach of duty by ABT or an intentional or negligent breach of duty by a legal representative or vicarious agent of ABT;
- if ABT is liable under the Product Liability Act for personal injury or damage to privately used items;
- in the event of fraudulent concealment of a defect or on the basis of a guarantee given.
In these cases, the statutory provisions remain applicable.
For material defects and defects of title in goods with digital elements, the provisions of this section do not apply to the digital elements; instead, the statutory provisions apply.

2. If there are defects, the Contracting Party who is a consumer within the meaning of § 13 BGB is entitled to the statutory warranty rights in accordance with the following provisions: Defects in the purchased item must be described precisely by the Contracting Party. The notice of defects must be given in text form pursuant to § 126b BGB, setting a reasonable deadline for remedying the defect.
If the object of the order becomes inoperable due to a material defect, the Contracting Party may, with ABT's prior consent, also contact another master motor vehicle workshop, preferably an authorised brand partner of ABT. In this case, it must be stated on the order form that the work is the remedying of a defect on behalf of ABT and that the removed parts must be kept available for ABT for a reasonable period. ABT is obliged to reimburse the Contracting Party for the reasonable repair costs demonstrably incurred.
Claims of the Contracting Party due to material defects in the delivery of new items become time-barred two years after delivery of the purchased item, unless otherwise agreed in the following paragraphs.
Claims of the Contracting Party due to material defects in the delivery of used items become time-barred one year after delivery of the purchased item, unless otherwise agreed in the following paragraphs.
Claims of the Contracting Party due to defects in the object of the order become time-barred two years after performance and its acceptance, unless otherwise agreed.

The following exclusion of liability does not apply

- in the event of an intentional breach of duty by ABT;
- in the event of a grossly negligent breach of duty by ABT or an intentional or grossly negligent breach of duty by a legal representative or vicarious agent of ABT;
- in the event of damage resulting from injury to life, body or health based on a negligent breach of duty by ABT or an intentional or negligent breach of duty by a legal representative or vicarious agent of ABT;
- if ABT is liable under the Product Liability Act for personal injury or damage to privately used items;
- in the event of fraudulent concealment of a defect or on the basis of a guarantee given.
In these cases, the statutory provisions remain applicable.
For material defects and defects of title in goods with digital elements, the provisions of this section do not apply to the digital elements; instead, the statutory provisions apply.
3. In the case of justified claims for material defects, ABT shall, at its option, either rectify the defect or provide a replacement delivery. The Contracting Party is obliged to accept a replacement delivery in return for the defective goods. If ABT does not remedy defects within a reasonable grace period set in text form pursuant to § 126b BGB, the Contracting Party is entitled to demand either rescission of the contract or an appropriate price reduction.
The Contracting Party may only claim damages for consequential damage caused by defects pursuant to § 280 BGB. Further claims for damages, in particular for damage caused by defects pursuant to § 281 BGB, are excluded.
Claims of the Contracting Party for reimbursement of expenses pursuant to § 445a para. 1 BGB are excluded, unless the last contract in the supply chain is a consumer goods purchase or a consumer contract for the provision of digital products.

4. If ABT is liable under the statutory provisions for damage caused by slight negligence, ABT's liability is limited: Liability exists only in the event of a breach of essential contractual obligations, such as those which the contract specifically intends to impose on ABT according to its content and purpose, or whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance the Contracting Party regularly relies and may rely. This liability is limited to the typical damage foreseeable at the time the contract was concluded. Insofar as the damage is covered by insurance taken out by the Contracting Party for the relevant case of damage (excluding fixed-sum insurance), ABT is only liable for any associated disadvantages for the Contracting Party, e.g. higher insurance premiums or interest disadvantages until the damage is settled by the insurance company.
The personal liability of ABT's legal representatives, vicarious agents and employees for damage caused by them through slight negligence is excluded.
§ 11 para. 1 and 2 of the GTC apply accordingly to the aforementioned limitation and exclusion of liability.

5. Damage resulting from insufficient or incorrect information provided by the Contracting Party, from improper handling or excessive use by the Contracting Party, from failure to observe the regulations on the handling, maintenance and care of the object of the order (e.g. operating instructions, service booklet, etc.), or from the Contracting Party or third parties commissioned by it making modifications or repairs to the object of the order without ABT's approval, is excluded from liability for material defects.

6. Normal, customary wear and tear does not constitute a material defect and is therefore excluded from the warranty; in particular, damage resulting from wear due to above-average mileage (> 30,000 km/year) is also excluded from the warranty.

7. The parties are aware and agree that motorsport parts are short-lived, high-performance products that are generally not approved for use on public roads. In such a case, the general operating permit expires. Subject to any other clear agreement, ABT does not guarantee that the object of the order meets the requirements for road traffic.

§ 12 Liability for Other Damage

1. ABT is liable for simple negligence only in the event of a breach of cardinal obligations. Cardinal obligations are essential contractual obligations whose breach jeopardises the purpose of the contract, or whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance the Contracting Party may regularly rely. In the event of a simply negligent breach of cardinal obligations, ABT's liability is limited to compensation for the typical damage foreseeable for ABT at the time the contract was concluded. The amount of the claim for damages is limited to the foreseeable damage typical for the contract. Damage caused by delay to the Contracting Party is limited to 5% of the purchase price.
In all other respects, ABT's liability for simple negligence is excluded.

The above exclusion of liability and the above reductions of the limitation period do not apply

- in the event of damage resulting from injury to life, body or health based on a negligent breach of duty by ABT or a negligent breach of duty by a legal representative or vicarious agent of ABT;
- if ABT is liable under the Product Liability Act for personal injury or damage to privately used items.
2. Liability for delay in delivery is conclusively governed by § 3 of the GTC. For other claims for damages against ABT, the provisions in § 11 no. 1 to 6 of the GTC (liability for material defects) apply accordingly.
3. In case of doubt, statements made by ABT in connection with the contract (description of services, reference to DIN standards) do not constitute the assumption of a guarantee. The assumption of a guarantee by ABT requires an express written declaration by ABT.

4. Liability for the loss of money or valuables of any kind that have not been expressly taken into safekeeping is excluded.
5. If the Contracting Party is a consumer within the meaning of § 13 BGB and the object of the contract also includes the provision of digital content or digital services, and the vehicle can fulfil its function even without these digital products, the statutory provisions of §§ 327 et seq. BGB apply to this digital content or these digital services.

§ 13 Prices, Invoicing and Payment

1. For contracts with Contracting Parties who are consumers within the meaning of § 13 BGB, the prices stated by ABT include VAT and any packaging costs incurred. For contracts with Contracting Parties who are a special fund under public law or an entrepreneur within the meaning of § 1 para. 1 of the GTC, net prices are generally stated which do not include the applicable statutory German VAT. The applicable statutory German VAT must be added to these prices. The VAT to be added shall be borne by the Contracting Party.

2. The prices stated on ABT's website are exclusive of any delivery and shipping costs incurred. For deliveries to countries outside the European Union, further costs may be incurred in individual cases for which ABT is not responsible and which are to be borne by the Contracting Party. These include, for example, costs for money transfers by credit institutions (e.g. transfer fees, exchange rate fees) or import duties or taxes (e.g. customs duties).
3. ABT is entitled to demand a reasonable advance payment when the order is placed. If payment in advance has been agreed, payment is due immediately after conclusion of the contract without deduction; otherwise, the invoice amount and the prices for ancillary services are due for payment without deduction upon acceptance of the vehicle and handover/dispatch of the invoice, but no later than 1 week after notification of completion and handover/dispatch of the invoice.

4. The following provisions regarding price adjustment are agreed between ABT and a Contracting Party who is a special fund under public law or an entrepreneur within the meaning of § 1 para. 1 of the GTC:
All prices contained in ABT's offer for wages, materials, raw materials, land or sea freight, taxes, customs duties or market-based purchase prices are calculated on the basis of the wage costs, purchase prices, taxes and customs duties at the time the offer was prepared.
The agreed price may be adjusted if demonstrable changes occur after conclusion of the contract in the wage costs, purchase prices, taxes and customs duties listed in the offer on which the price calculation is based. The adjustment is made to the extent necessary to maintain the balance between performance and consideration.
Price reductions due to lower cost factors are taken into account in the same way.

5. The following provisions regarding price adjustment are agreed between ABT and a Contracting Party who is a consumer within the meaning of § 13 BGB:
All prices contained in ABT's offer for wages, materials, raw materials, land or sea freight, taxes and customs duties are calculated on the basis of the wage costs, purchase prices, taxes and customs duties at the time the offer was prepared.
The agreed price may be adjusted if demonstrable changes occur after conclusion of the contract in the wage costs, purchase prices, taxes and customs duties stated in the offer on which the price calculation is based. The adjustment is made to the extent necessary to maintain the balance between performance and consideration. Price reductions due to lower cost factors are taken into account in the same way.
6. Any correction of the invoice by ABT, as well as any complaint by the Contracting Party, must be made no later than 6 weeks after receipt of the invoice.

§ 14 Set-off and Retention

1. The Contracting Party may only set off against claims of ABT if the Contracting Party's counterclaim is undisputed or has been legally established.
2. The Contracting Party may only assert a right of retention insofar as it is based on claims arising from the contractual relationship.

§ 15 Extended Lien

1. For its claims arising from the order, ABT has a contractual lien on the object of the order that has come into its possession on the basis of the order. The contractual lien may also be asserted for claims arising from work carried out previously, deliveries of spare parts and other services, insofar as they are connected with the object of the order.
2. ABT is entitled to realise the lien by way of private sale. Written notification to the last known address of the customer is sufficient for the threat of sale of the pledged item.

3. For other claims arising from the business relationship, the contractual lien applies only insofar as these are undisputed or have been legally established and the object of the order belongs to the Contracting Party.

§ 16 Confidentiality

The Contracting Party is obliged to maintain confidentiality regarding all information that becomes known to it in connection with the contractual relationship with ABT, regardless of whether it concerns ABT itself or its business connections, unless ABT releases it from this duty of confidentiality.

§ 17 Access to the Website

ABT does not guarantee that its website can be reached and is available at all times and for an unlimited period. If only limited or no access to the website is possible due to unscheduled or scheduled maintenance and service work, ABT will endeavour to remedy the error as quickly as possible.

§ 18 Notice pursuant to § 36 of the Consumer Dispute Resolution Act (VSBG)

ABT does not participate in dispute resolution proceedings before a consumer arbitration board within the meaning of the VSBG and is not obliged to do so.

§ 19 Applicable Law and Place of Jurisdiction

1. The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). This choice of law includes that a Contracting Party whose habitual residence is in one of the states of the EU or in Switzerland is not deprived of the protection afforded by mandatory provisions of the law of that state.

2. If the Contracting Party is a merchant, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from the contract is ABT's registered office in Kempten.
The same applies if the Contracting Party has no general place of jurisdiction in Germany or the EU, or if its domicile or habitual residence is not known at the time the action is filed.
ABT's right to also bring an action before the court at another statutory place of jurisdiction remains unaffected.
